Terms of Use

1. Provider and scope

These terms govern your use of the app. If you download it from the Apple App Store, Apple’s Standard License Agreement (EULA) applies as well; on Google Play, the Google Play Terms of Service apply in addition.

2. Not a medical device

Contraction Timer helps you record how long your contractions last and how far apart they are, and shows when a pattern you chose (such as the 5-1-1 rule) is reached. The app does not diagnose anything, does not replace medical advice and is not a medical device. Rules such as 5-1-1 are general guidance; what applies to you is something to agree with your midwife, your doctor or your hospital.

If you notice warning signs – such as bleeding, your waters breaking, noticeably fewer movements of your baby, severe constant pain or a fever – contact your hospital immediately, whatever the app shows. In an emergency, call your local emergency number.

Do not rely on the app’s hints and alarms alone. Your phone’s operating system can delay or suppress notifications (for example through battery saving, Do Not Disturb or missing permissions), and the evaluation depends on you recording your contractions.

3. Free use

Everything you need to keep count and to decide “should I call now?” – the timer, the history, editing, the clinic hint with a call button, warning signs – is free and needs no account. The app shows no ads.

4. Premium

Premium unlocks additional comfort features (for example statistics, pattern detection, PDF export, the watch apps and all breathing exercises). You buy Premium exclusively through the Apple App Store or Google Play. Payment, billing, refunds and any right of withdrawal are governed by the terms of the respective store; Apple or Google is your contracting party for the payment. Current prices are shown in the app and in the store.

• Weekly subscription: new users can try Premium free for 3 days. If you cancel during the trial, you are not charged. After that, the subscription renews automatically for one week at a time unless you cancel it at least 24 hours before the end of the current period. You manage and cancel it in the subscription settings of your Apple or Google account. Deleting the app does not cancel a subscription.
• One-time purchase (“lifetime”): a single purchase with no term and no renewal. It belongs to the store account you bought it with and can be unlocked on further devices with the same account via “Restore purchases”.

5. Licence

You receive a simple, non-transferable right to use the app for private purposes. You may not modify, decompile or redistribute the app unless the law expressly allows it.

6. Your data and availability

Your contractions and settings are stored only on your device (see the privacy policy). If you delete the app or reset your device, this data is lost unless it is part of a device backup.

We keep developing the app and may change, add or remove features. We will not restrict essential Premium features you paid for without good reason. There is no entitlement to uninterrupted availability of the app or of individual features.

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breaches of essential contractual obligations – obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely – and in that case only for the foreseeable damage typical for this kind of contract. Any further liability is excluded. Your statutory warranty rights remain unaffected.

8. Changes to these terms

We may update these terms, for example when the app or the law changes. The current version is always available at this address and in the app under Settings → Terms of use. We will inform you of material changes in the app.

9. Applicable law and dispute resolution

German law applies. If you are a consumer and habitually reside in another country, the mandatory consumer protection rules of that country remain unaffected.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If something goes wrong, just write to us – we are happy to find a solution.
